What do you think of anime and eroge where they have girls who look like they are 5 but set the characters age as being way older? Like Moetan - shes supposed to be 16 or something right?

Loli manga/ anime/ and games are legal in Japan if I remember correctly. I know it is in the US. Yet it's still disturbing, and looked down upon. Then again, anything loli never is sold because of all the crap that can be thrown at the publisher in the US.

It's just drawings and not real so who cares? Banning it would be as ridiculous as banning computer games because of pixel blood. Governments usually still have real problems to take care of.
This isn't exactly matching my taste either, but banning it for this very reason would be idiotic and wouldn't help anyone.

It depends on other rules set in the universe where the story takes place. If it clearly stands out relevant to the rest of the content, and it isn't done so for comedy, then I question its use as an excuse to bypass censorship.
If there is no other justification for whatever takes place as a result of this sort of disclaimer, and this naming is consistent inside of that storyworld, I accept it to be the norm for that storyworld.
Similar is when protagonists just happen to not be human, as justification for ...humanizing them and neglecting social standards when situations questioning human behavior, occur.

I could care less, in 2D everything has no "age", you could have a woman who looks like she is 80 be 17 years old, because it's just that, it's not real.
I've watched countless anime where the females look younger like Moetan, and even anime where the female IS that "young" like Kodomo No Jikan. To me it's a style, and nothing more. I prefer the 'loli' look over the women who have breasts 2x the size of their head, and look like they can float in water. To me giant breasts like that is more of an annoyance than anything else.
Does that preference that I have of a loli style over an "adult" appearance make me attracted to real life children? Nope, it doesn't. Sure I think little kids are cute, but that's it. In my mind, loli anime style and real life kids are separate things.
Of course we have those here and elsewhere on the net, that feel the 'loli' appearance is enough to make them scream "taboo" and associate it with people who think sexually of real life children, but thats far from the case with a huge majority of people who like the 'loli' style.
I think for most, its kind of like a scene reference, its nothing more than a joke, and the opinion of most that the style is moe.

Dude you obviously have not seen many anime have you?
One example is Tenjou tenge, one of the characters have a form of a 11 year old girl, but when she gets serious she transforms into a 17-18 year old with huge breasts.
There are other animes where a character looks young but is actually hundreds of years old, example would be bleach. Many of the shinigamis are hundreds of years old, but they look young?
I could keep going on, but nothing I said is an extreme example, because they all EXIST in anime.
